DCY Transfers Administrative Rules – New Numbering System

The Department of Children and Youth (DCY) is transitioning administrative rules to a new chapter.  Because numerous child-focused programs and initiatives transferred from other state agencies to DCY, the administrative rules governing them must transfer as well. This transfer includes renumbering those rules in the Ohio Administrative Code (OAC). Please read this Guidance Letter from the Division of Policy for more information.

The Ohio Department of Children and Youth (DCY) was established in July of 2023 with the state’s main operating budget, House Bill 33 (HB 33). As a result, numerous child-focused programs and initiatives are being transferred to DCY from various state agencies, creating a centralized resource where Ohio families can ask questions, find services, and receive support. In addition to the movement of child related services to DCY, HB 33 provided for the transfer of the administrative rules governing them.

A necessary part of the rule transfer includes renumbering the rules to fall under DCY’s newly created Ohio Administrative Code (OAC) agency number 5180. To help simplify this process, all rules will retain their current number with the exception of the first four digits, swapping them from their present, or legacy agency number, to the new 5180.

Here are a few things to keep in mind during this transfer:

  • The transfer of rules to DCY will not change the content or enforcement of the rules, only their numbers.
  • Resources, like Codes.ohio.gov and the Register of Ohio (https://www.registerofohio.state.oh.us/home) may not show the updated rule number in January, but a notice should accompany any transferred rule indicating its move to DCY. A rule’s number will be updated the next time DCY updates the rule.
  • As DCY modifies rules moving forward, additional numbering changes should be expected as rules move to their final divisions and chapters.
