Proposed Rule Changes for Intermediate Care Facilities for Individuals with Intellectual Disabilities (OAC 5160-3-99)

The Ohio Department of Medicaid (ODM) has released proposed changes to Ohio Administrative Code Rule 5160-3-99, “Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICF/IIDs)”.

Rule 5160-3-99, “Payment methodology for state-operated intermediate care facilities for individuals with intellectual disabilities (ICFs/IID),” has undergone its five-year review and will be proposed for amendment. This rule describes the methodology for calculating payment rates for ICFs/IID operated by the Ohio department of developmental disabilities (DODD).

The changes to the rule will include:

  • Clarifying language is being added and superfluous language is being removed; • Administrative Code references are being updated.
  • Citations are being updated.
  • CFR effective dates are being updated.
  • Regulatory restrictions are being removed throughout the rule.
